ROYALTIES It is common in some industries, especially the entertainment and sports industries, to reimburse some of the compensation for products or services in the form of future royalties. Other common occurences of the use of royalties is in the mining industry for mineral rights and for patent rights. The average term of the payments purchased is five years but each transaction is different and the current holder of the rights (copyright,patent,etc) retains ownership of those rights. Transaction sizes generally range between $250,000 and $5 million but there is no maximum. We can often provide immediate cash for those future payments if the right to their possession is contractually clear and there are no severe contingencey clauses. For example, some sports contracts have performance contingencies which may or may not be met and in those cases we will not be able to fund. ANNUITIES A fixed or variable annuity, generally purchased through an insurance company, provides future payments to an annuitant or his/her beneficiaries. The payment terms between contracts vary considerably, but we can arrange to provide cash for those future payments if the annuity is assignable. LEASES We can often arrange funding for long term leases where the lessor receives a triple net rent, i.e., the lessee pays all expenses for property taxes, utilities, insurance premiums and maintenance costs. Most of these net leases also include some provision for escalation of the periodic lease payments. Some common uses recently include cell phone tower leases, billboard leases and commercial and industrial buildings. Some problems that could preclude funding include flexible terms, short 180-day termination clauses or contingency clauses that could significantly affect the lease payment. NOTES ON LARGE ASSETS This product refers to those situations where an owner of a large asset such as an airplane, a boat or an RV sells the asset and takes back a note as part of the compensation.
